Welcome to AVENUE TAX SERVICE, operated by JNI SERVICES LLC (“we,” “us,” “our,” or
“the Company”). These Terms and Conditions (“Terms”) govern your use of our website,
services, and communications, including interactions through AI voice assistance and SMS
messaging.
By accessing or using our Services, you agree to these Terms. If you do not agree, please do
not use our Services.
- USE OF SERVICES
Our Services include tax preparation, filing assistance, consultation, and related support
offered through our website, offices, and communication channels — including phone, email,
AI voice systems, and SMS text messaging.
You agree to use our Services only for lawful purposes and in compliance with these Terms
and all applicable laws and regulations.
- COMMUNICATIONS AND CONSENT
By providing your contact information, you consent to receive communications from us
through various methods, which may include:
- Phone calls (manual or automated)
- Emails
- SMS text messages
- AI voice assistance or automated voice systems
- In-app or online notifications
These communications may include service updates, appointment reminders, document
requests, verification notices, and important information related to your tax filings or account.
AI and Automated Systems Disclosure:
When you interact with our AI voice or messaging systems, you will be notified that automated
technology is being used. You may request to speak with a human representative at any time
during such interactions.
Consent for Marketing and Automated Communications:
By providing your phone number or email, you grant Avenue Tax Service express written
consent to contact you via automated systems, including AI voice calls and SMS messages,for both service-related and promotional purposes. You can revoke your consent for
marketing communications at any time by replying “STOP” to SMS messages, using the
unsubscribe link in emails, or contacting us directly at info@avenuetaxservices.com.
Essential service messages — such as those required for account verification, legal
compliance, or active filings — cannot be opted out of while your account or service request
remains active.
- ACCURACY OF INFORMATION
You are responsible for ensuring that all information you provide through any communication
channel (including AI voice or SMS systems) is accurate, complete, and up to date.
We are not liable for any delays, misfilings, or service errors caused by incorrect or
incomplete information you supply. If any transcription errors occur due to automated or voice
recognition systems, please notify us immediately at office@avenuetaxservices.com. Avenue
Tax Service may retain AI-generated transcripts for up to twelve (12) months for quality
assurance and compliance.
- USER RESPONSIBILITIES
You agree not to misuse or interfere with our communication systems, including AI, SMS, or
voice automation tools. This includes avoiding:
- Providing false, misleading, or unlawful content
- Attempting to access, intercept, or reverse-engineer our systems or software
- Using unauthorized bots, scrapers, or scripts to engage with our systems
- Uploading or transmitting malicious code, spam, or fraudulent data
Any misuse may result in immediate suspension or termination of service and potential legal
action under applicable laws, including the Computer Fraud and Abuse Act (CFAA) and the
Telephone Consumer Protection Act (TCPA).
- PRIVACY
Your use of our Services — including AI voice or SMS interactions — is governed by our
Privacy Policy, available at https://avenuetaxservices.com/privacy-policy.
By using our Services, you acknowledge and agree to the practices described in that policy.
Avenue Tax Service does not sell personal information or voice data and does not use AI
recordings for biometric identification. We process such data solely to deliver Services, verify
identity, improve accuracy, and comply with applicable financial and data protection laws.
- DATA SECURITY AND RETENTION
We implement reasonable and appropriate technical, administrative, and physical safeguards
to protect your personal and tax-related information from unauthorized access, disclosure,alteration, or destruction.
These measures include encrypted data storage, employee confidentiality agreements, and
monitoring of AI communications for accuracy and misuse prevention.
Tax data is retained for at least seven (7) years as required by the IRS. Voice recordings and
AI-generated transcripts are stored for up to twelve (12) months before being securely deleted
or anonymized.
- SERVICE MODIFICATIONS
We reserve the right to modify, suspend, or discontinue any part of our Services, including AI
or messaging-based features, at any time without notice or liability. We may also update these
Terms periodically, and continued use after updates constitutes acceptance of the revised
Terms.
- LIMITATION OF LIABILITY
To the fullest extent permitted by law, JNI SERVICES LLC (doing business as Avenue Tax
Service) and its affiliates shall not be liable for any indirect, incidental, or consequential
damages arising from your use of our Services, including interactions through AI voice
assistance or SMS messaging.
We are not responsible for:
- Transmission delays, carrier issues, or failures caused by networks or third-party messaging
platforms
- Misinterpretation, transcription, or response errors generated by automated or AI systems
- Unauthorized access or disclosure resulting from causes beyond our reasonable control
In no event shall Avenue Tax Service’s total liability exceed the total fees paid by you for
Services during the twelve (12) months preceding the claim.
- GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of
Texas, without regard to its conflict of law principles. Any disputes shall be resolved
exclusively in the courts of Dallas County, Texas, unless otherwise required by law. If any
provision is found unenforceable, the remaining provisions shall remain in effect.
